Sungrove Villas – Terms & Conditions of Booking

These Terms & Conditions form the basis of all bookings made through Sungrove Villas (“Sungrove”, “we”, “us”, “our”), acting as booking agent and property manager for independently owned holiday homes.

By confirming a booking, the Lead Guest agrees to these Terms on behalf of all members of the party.

1. Agency Status & Contractual Structure

Sungrove Villas acts solely as a booking agent for independently owned holiday properties (“Property Owner(s)”). Sungrove Villas does not own the accommodation unless expressly stated.

The accommodation contract is formed directly between the Guest and the Property Owner. Sungrove Villas facilitates booking services, payment processing, guest communications, and operational management on behalf of the Property Owner.

All references to “we”, “us”, or “our” refer to Sungrove Villas acting in this capacity.

2. Booking Confirmation & Guest Eligibility

The Lead Guest must be 21 years of age or older and is responsible for all persons included in the booking.

A booking is only confirmed once:

  • The booking has been accepted by Sungrove Villas

  • Required payment/deposit has been received

  • Written confirmation has been issued

By submitting a booking request or payment, the Guest confirms acceptance of these Terms.

We reserve the right to decline or cancel any booking where:

  • False information has been provided

  • Maximum occupancy is exceeded

  • The booking breaches property, legal or HOA/community rules

  • The booking involves prohibited group types (including hen/stag or party groups)

Only registered guests listed on the booking may occupy the property. Subletting, sharing, assignment or transfer is strictly prohibited.

No parties, events, or gatherings of any kind are permitted.

No hen or stag groups accepted.

Pets are not permitted.

3. Payments

All payments are processed by Sungrove Villas on behalf of the Property Owner.

Payment schedules must be strictly adhered to. Failure to pay by due dates may result in cancellation and forfeiture of monies in accordance with Section 10.

4. Rental Period & Occupancy

Minimum stay: 7 nights (unless otherwise agreed)

Check-in: 4:00pm local time
Check-out: 10:00am local time

Late departure may incur additional charges up to the cost of one additional night.

Maximum occupancy must not be exceeded at any time, including daytime visitors unless expressly authorised in writing.

5. Price & Inclusions

The agreed rental price is confirmed upon booking and guaranteed once payment is received.

Price changes only apply where:

  • Amendments are requested

  • Additional services are added

  • External taxes or mandatory charges change beyond our control

6. Guest Conduct, Behaviour & Termination

Guests agree to maintain respectful conduct and comply with property and community rules.

Strictly prohibited:

  • Parties or events

  • Excessive noise or nuisance behaviour

  • Illegal activity

  • Breach of occupancy limits

  • Disturbance to neighbours or HOA/community rules

Sungrove Villas, the Property Owner, or Management Company reserve the right to terminate occupancy immediately without refund in the event of breach of these Terms.

7. Amendments & Property Availability

Requests for amendments must be made in writing and are subject to availability and approval.

In rare circumstances, a property may become unavailable due to reasons outside our control, including but not limited to sale, withdrawal, maintenance issues, or change of ownership/management.

Where this occurs, we will:

  • Offer suitable alternative accommodation of similar standard, where available; or

  • Provide a full refund of accommodation monies paid

No further liability shall be accepted for consequential losses.

8. Security Bond

£200 refundable security bond is required for all bookings.

The Lead Guest is responsible for all damage, loss, breakages, excessive cleaning, or breach of Terms during the stay.

The bond may be used for:

  • Property damage or missing items

  • Excess cleaning requirements

  • Misuse of facilities

  • Rule breaches

Bond returns are typically processed within 14 days of departure, subject to inspection.

Additional costs exceeding the bond will be invoiced and payable within 14 days of notification.

9. Guest Responsibilities & Property Condition

Guests must maintain the property in a reasonable condition during their stay.

All issues or damage must be reported immediately to the Management Company to allow rectification.

Unless reported within 24 hours of arrival, the property will be deemed accepted in satisfactory condition.

BBQs, kitchenware and facilities must be left in a reasonable condition.

10. Cancellation by Guest

All cancellations must be submitted in writing.

Cancellation charges:

  • More than 10 weeks prior: deposit forfeited

  • Within 10 weeks: 100% of all monies paid forfeited

No refunds will be given for:

  • Non-arrival

  • Late arrival

  • Early departure

  • Unused nights

11. Cancellation by Sungrove Villas / Property Owner

Where cancellation is required due to property unavailability or circumstances beyond reasonable control, Sungrove Villas (acting for the Property Owner) will refund accommodation payments received.

No liability is accepted for travel costs, alternative accommodation, or consequential losses.

12. Travel Insurance

Guests must hold comprehensive travel insurance covering cancellation, medical needs, personal belongings, and travel disruption.

13. Force Majeure

We accept no liability for disruption or cancellation caused by events outside our control, including but not limited to:

  • Natural disasters or extreme weather

  • Hurricanes or flooding

  • War, terrorism or civil unrest

  • Pandemics or government restrictions

  • Utility failures

  • Transport disruption

  • Industrial action

No compensation shall be payable in such circumstances.

14. Complaints & Resolution Process

Any issue must be reported immediately to the local Management Company during the stay.

Post-departure complaints regarding unreported issues will not be considered.

15. Property Facilities, Services & Interruptions

All facilities and services (including WiFi, utilities, appliances, and community amenities) are provided where available but are not guaranteed.

Temporary interruption or failure does not constitute a breach of contract and does not entitle guests to compensation.

Community facilities may be closed, restricted, or unavailable without notice.

16. Limitation of Liability

Sungrove Villas acts solely as booking agent and property manager and accepts no liability for:

  • Injury, illness, accident or death

  • Loss or damage to personal belongings

  • Utility or service interruptions

  • Construction, maintenance or neighbourhood disturbance

  • HOA or community facility changes

Guests use all facilities, including pools and spas, at their own risk.

Children must be supervised at all times, particularly in pool areas.

Glass is strictly prohibited around pools.

17. Right of Entry

Sungrove Villas, Property Owners, and authorised Management Company representatives reserve the right to enter the property at reasonable times for inspection, maintenance, or emergency purposes.

18. Pool & Spa Heating

Pool and spa heating is an optional paid service where available.

Due to environmental conditions, temperatures cannot be guaranteed.

No refunds will be issued where systems are operational but affected by weather conditions.

19. Smoking Policy

All properties are strictly non-smoking indoors.

Smoking is permitted only in designated outdoor areas where applicable.

Damage or cleaning costs resulting from smoking will be charged to the security bond.

20. Pests & Environment

Due to Florida’s climate, insects and pests may be present despite regular treatment.

No compensation will be provided for environmental pest activity.

21. Management Company Role

The local Management Company is responsible for operational support during stays.

All maintenance issues must be reported to them directly.

Sungrove Villas cannot resolve issues that have not been reported during the stay.

22. No Waiver of Rights / Disputes Time Limit

Any complaints must be submitted within 28 days of departure.

23. Governing Law

These Terms are governed by the laws of England and Wales, with exclusive jurisdiction of the English Courts.
